4-year-old killed in crash outside Kentucky football stadium

A 4-year-old boy died after he was struck by an allegedly drunk driver outside of a University of Kentucky football game.

The driver, an 18-year-old Kentucky student, has been charged with DUI; his attorney entered a not guilty plea on his behalf. He is next scheduled to appear in court on Oct. 26.

At the time of the crash, the boy and his family were standing on the side of the road, waiting to cross the street.

The driver said he had consumed two beers around 9:30 a.m. at a tailgate event and left. He was arrested about 2:45 p.m. Police said his blood alcohol content (BAC) as .05 – more than double the .02 state limit for drivers under the age of 21.

When a driver causes an accident that leads to serious injury or death, that is an aggravated circumstance under Kentucky law.

The driver, a freshman on campus, has been suspended by the university.

In related news, the university suspended the fraternity the driver had pledged, and the national fraternity revoked the chapter’s charter. The fraternity headquarters said an investigation showed the chapter had violated the organization’s health and safety policy.

The university revealed that a preliminary investigation showed that fraternity members bought alcohol to serve on game day at what school officials called an “unregistered tailgate event off campus”.

The university president said in an email sent to the campus community that everyone affiliated with the school is “heartsick” at the boy’s death.

“Please join us in extending our deepest condolences to his family and other loved ones. They are part of our family, and we will always be there for them,” the email said.
