Patient who was seriously injured in hospital shower files lawsuit

Many Kentucky residents have experienced being a patient in a hospital and probably assumed the facility follows an appropriate standard of care at all times, but unfortunately, that is not always the case. Sometimes, what began as a serious injury develops into a much worse situation due to surrounding circumstances, and in some cases, those circumstances are a direct result of the negligence of another person or entity. A man who suffered serious injury during a hospital stay believes this was the case for him. Recently, the former patient filed a lawsuit against the hospital and other associated entities. He alleges hospital staff were negligent in preventing the fall that led to his injuries.

According to the lawsuit, the man had been a patient at the hospital, which is in a different state, in Oct 2017. He had previously suffered a head injury that required surgery and was at the hospital for rehab treatment. Sometime during his hospital stay, he fell while coming out of the shower. That fall caused injuries to his right hip, shoulder, neck, back and head. The lawsuit asserts that these injuries led to diminished physical and cognitive abilities.

The man alleges hospital staff failed to maintain upkeep on the shower and should have warned him it was malfunctioning. As well, staff failed to implement and follow a program designed to prevent such falls. Reportedly, the incident left the man with some permanent injuries requiring extensive treatment that has significantly affected his lifestyle. According to the suit, he is seeking $5 million.

In the lawsuit, the plaintiff asserts that ultimately, this unfortunate incident has affected him physically, emotionally and financially. He says some of his injuries will affect him for the rest of his life. Likely, all Kentucky residents would agree that any medical facility has a responsibility to offer a safe environment for all its patients, including protocols and other resources designed to help maintain this goal. This hospital may have been negligent in meeting this standard, leading to this man’s injuries, and if successful, the lawsuit will ensure that the responsible parties are held accountable, as well as give him some relief from his financial burdens.
